Terms & Conditions

Generally, you will be asked to sign a contract before your event. However, it is accepted that by booking us you have read, understood and agreed to the terms and conditions stated below.

It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this shall be effective unless agreed by both parties in writing.

Booking & Cancellation : The Booking Fee (50%) secures the time and services of the Photographer(s) for the event and is non-refundable or transferable in the case of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Cancellation less than 4 weeks before the event will result in the payment in full. All cancellation must be in writing. Events or Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time. The fee for postponed Wedding or Event is subject to change.

Payment Terms : 50% advanced payment | 25% payment on day of event | 25% payment on day of delivery

No Photographs, USB or Optional Extras will be delivered until all payments due have been paid in full. Payment may be made in cash or bank transfer payable. Payment for additional Attendance Hours (part or whole) where agreed, but which may not be known accurately at the time of Contract signing, must be made at the post wedding or event delivery meeting.

Cooperation : The Clients and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. We recommend that the Photographer be provided with a helper (usually the best man) who will point out key individuals to be photographed. The Photographer may also require the assistance of the best man in organizing family groups. The Clients also agree to give the Photographer sufficient warning of key events at the event or wedding to give the Photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at events or weddings like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.

The Schedule : Our shooting schedule, style of working and experience are designed to achieve a great set of wedding photos for the Clients, accomplished with good humor and enjoyed by all concerned. Both the Clients and the Photographers therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding or event does not run on time (for example, extreme lateness by one of the Clients) we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best to compensate.

Confirmation : Client will receive a confirmation mail or message and a receipt on receiving the Booking amount. This mail confirms the Booking with ‘Krishna Shah Photography‘. Any verbal communication DOES NOT guarantee a booking if the advance amount is not paid.

Delivery : Pre-wedding : 3-5 Weeks after the service date in off-season or up to 5 Weeks after the service date in peak season. Wedding : Subject to duration of photography services. The more drawn out of photography services implies we will produce more photographs and it will require longer time for post processing. For the most part we may convey the outcome in 3-6 Weeks after the service date in off-season or maximum 6 Weeks in peak season. Other Events : Subject to duration of photography services. For the most part we may convey the outcome in 1 Week after the service date in off-season or maximum 3 Weeks in peak season.

Images & Retouching : All image sizes are nominal & are given in High Quality to the clients. ‘Krishna Shah Photography‘ will (as a minimum) perform a standard amount of retouching to take the photographs to a quality which he considers to be appropriate.

Copyright Law : The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer.

Model Release : The Clients grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.

Attendance : In the unlikely event of the assigned Photographer being unable to attend your event due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your event on our behalf to undertake the photography to his/her best ability.

Travel and Subsistence : For attendance at venues at a distance over 20 KM radius, travel costs will be charged where appropriately. Where the wedding and ceremony require an overnight or longer stay, outside Vadodara (Baroda), then modest hotel and subsistence charges will be made, else client has to accommodate our team.

Complaints : Any complaints should first be raised by the Client with the Photographer in writing within 15 days from the date of receipt of images.

Files Handling/Backup : Please be noted that we will delete all your wedding/event files 6 months after our service date. A debt of gratitude is in order for your cooperation to reply our email or message.

Disclaimer : The photographer reserves the right to amend, vary or cancel these Terms and Conditions at any time. If we change our T&Cs, one can visit this page.

Both parties will automatically agree to the mentioned terms on Booking.
